These Terms and Conditions (“Terms”) govern your access to and use of the services provided by Elixir Digital Media (“we,” “our,” or “us”), including but not limited to digital marketing, website designing, web development, SEO, branding, and social media management. By accessing our website or engaging our services, you agree to be bound by these Terms.
Definitions
Client/You: The individual or business who purchases services from Elixir Digital Media.
Deliverables: Any output provided by us as part of the services, including designs, reports, code, content, etc.
Agreement: A written proposal, contract, or invoice accepted by both parties that outlines the scope and terms of service.
Scope of Services
We offer:
- Custom website development and design (static and dynamic)
- SEO services (on-page, off-page, and technical SEO)
- Social media marketing and management
- Google and Meta Ads (PPC)
- Graphic and brand design
- Web hosting and domain management (if requested)
All services are customized based on the client’s goals, and a separate proposal will define the specifics.
3. Service Delivery Timeline
- Timelines are provided in the service agreement or proposal and depend on the promptness of client feedback, approvals, and inputs.
- Any delays from the client’s side (e.g., content submission, approvals) may extend the delivery timeline without penalty to Elixir Digital Media.
- Urgent requests or expedited deliveries may incur additional charges.
4. Client Obligations
Clients must:
- Provide clear, accurate, and timely information, content, or materials necessary for the project.
- Approve drafts and mockups within the agreed timeline.
- Ensure they hold rights to all content (text, images, videos, etc.) shared with us.
We are not liable for copyright or licensing issues arising from client-submitted content.
5. Revisions and Edits
- Most services include up to 2–3 rounds of revisions unless otherwise stated.
- Revisions must be requested within 7 days of delivery.
- Major changes to the original brief will be considered new work and quoted separately.
6. Payment Terms
- A minimum of 50% advance payment is required to initiate any project.
- The balance must be paid upon project completion or as per milestones mentioned in the proposal.
- Late payments beyond 7 days of due date may attract a 2% late fee per week.
7. Refund & Cancellation Policy
We strive to maintain transparency and fairness in our business dealings. The following policy outlines the terms related to cancellations and refunds for services rendered by Elixir Digital Media.
7.1 Project Cancellation by the Client
Before Project Start:
- If the client cancels the project before any work begins, a refund of 90% of the advance will be issued.
- 10% will be retained to cover administrative and consultation efforts.
After Project Start but Before First Deliverable:
- If the cancellation occurs after work has commenced but before the first milestone/deliverable, a refund of 50% of the advance will be issued.
After First Deliverable or Midway:
- If the client cancels the project after receiving part of the work, no refund will be issued for the completed portion.
- If the project is halfway and the client chooses to discontinue, no refund will be applicable, and the client may be billed proportionally for the completed work.
7.2 Digital Marketing & SEO Campaigns
- Campaigns (SEO, ads, content marketing) once started, involve third-party spending (e.g., ad credits, tools) and strategic planning.
- No refunds will be issued for active or completed campaign cycles.
- For long-term contracts, cancellation must be communicated in writing 30 days in advance.
7.3 Monthly Retainer or Ongoing Services
- Cancellation requires 15 days’ written notice via email.
- Any work already completed in that billing cycle will be billed and payable.
- The remaining amount (if any) will be refunded within the stipulated refund timeline.
7.4 Elixir Digital Media-Initiated Cancellations
- In rare cases where we are unable to proceed due to internal or technical reasons, we reserve the right to cancel the service.
- In such cases, a 100% refund of the unutilized portion will be issued.
7.5 Refund Timeline
- All eligible refunds will be processed within 7 to 15 business days from the date of approval.
- Refunds will be made through the original method of payment or any alternate method mutually agreed upon.
7.6 Non-Refundable Services

Payments made for:
- Domain registration
- Web hosting
- Third-party tools, themes, or plugins
- Consultation or strategy calls
- Express or rush deliveries
are non-refundable under all circumstances.
7.7 How to Request a Refund or Cancellation

- Subject: Refund/Cancellation Request – [Project Name or Invoice Number]
- Include a brief reason and relevant documents (if any)
- We will acknowledge your request within 48 working hours and begin internal processing.
8. Confidentiality
- We respect your privacy. All business data, strategy documents, credentials, and sensitive information will be kept strictly confidential.
- Clients agree not to disclose any of our internal processes, pricing, or technical documentation.
9. Intellectual Property Rights
- All final deliverables become the property of the client after full payment.
- We retain the right to use non-confidential portions of the project for portfolio and marketing purposes.
- We reserve the right to reuse custom code or components unless the client requests an exclusivity clause (may involve additional charges).
10. Warranties and Liabilities
- We do not guarantee rankings or business outcomes for SEO, ads, or digital campaigns. These depend on many variables outside our control.
- We are not responsible for issues arising due to third-party services like hosting providers, payment gateways, or platforms like Google/Facebook.
- In no event shall our liability exceed the total amount paid by the client.
11. Third-Party Tools and Integrations
- If your project involves integration with third-party platforms, plugins, or APIs, we are not liable for any service interruptions or changes made by those providers.
- Paid tools, plugins, or licenses required for your project will be billed separately unless included in the service agreement.
12. Termination of Services
We reserve the right to suspend or terminate services for:
- Non-payment
- Violation of these Terms
- Use of abusive or unethical language
- Illegal use of our services
13. Amendments
We reserve the right to amend these Terms at any time. Changes will be updated on our website or communicated via email. Continued use of our services indicates acceptance of revised Terms.
14. Governing Law and Jurisdiction
